Case Studies

A well known Nasdaq listed steel company challenged a decision of the German tax authorities on Stamp Duty Land Tax following a major merger. The company succeeded in the courts on exactly the grounds outlined in our original opinion. The legal situation had been uncertain; there had been no legal precedents to rely on.

We supported a foreign tax consultancy in the UK who asked for a VAT Cross-Border Ruling (pilot project of the European Commission) for its major multinational client operating in the chemical industry. The company needed certainty on the VAT impact of a sophisticated new business structure, which was to be set up for the enterprise as a whole. We prepared the legal argumentation, which was complicated; the request for the ruling was successful.

We advised a former company director whose life had become a misery after a personal security had been called in by the banks for his then insolvent company. We managed to find a crucial legal argument to crush the foundation of the banks' claim against him, leaving him a "free" man without any financial ties whatsoever.

A company in the medical industry searched for the best location from a VAT perspective to establish a hub for its worldwide deliveries worth many millions of Euros monthly. The VAT cost, compliance, and practical handling had to be assessed in each single country in cooperation with the company and various foreign VAT consultants in order to provide the optimal solution.

A company in the telecommunications industry had to convince more than ten of its mainly Asian suppliers to VAT register in Germany in order to rectify a misinterpretation of VAT laws. The potential exposure of the company to a tens of millions of Euros in VAT payments and penalties, which would have become a cost factor, was avoided.
